Requirements for the power of attorney
The power of attorney must clearly show who is giving power of attorney (the principal) and to whom the power of attorney is given (the attorney-in-fact). It must be evident if the power of attorney also includes the case being brought before the Ombudsman. Besides, the power of attorney form must be signed and dated by the person giving power of attorney.
It is an option to use the Ombudsman’s Power of attorney form.
Submitting the power of attorney form
An original signed power of attorney form can be sent to the Ombudsman as a letter in the post. Alternatively, the person giving the power of attorney can also send the power of attorney form via Digital Post. You can access Digital Post at for example Borger.dk.
If you choose to send a copy of the power of attorney, for instance via the complaint form or an insecure e-mail, we might ask for further documentation of the relationship between the principal and the attorney-in-fact. If we find that we need further documentation, we will make enquiries to the person who has lodged the complaint or to the person who has given the power of attorney (the principal).
Guardianship
If you are a legal guardian for the person on whose behalf you complain, you must submit a copy of the appointment of a guardian.
Revocation of power of attorney
The Ombudsman must be informed directly if the person who has given power of attorney (the principal) revokes the power of attorney. This applies whether the Ombudsman has received an original power of attorney or a copy of a power of attorney.
