What does the Ombudsman do with the information in the complaint

As a complainant you should expect that the Ombudsman notifies the authorities, which the complaint concerns, about the complaint. In some cases, the Ombudsman forwards complaints to the authorities. This is part of the case processing.

When a complaint is about a person, for example a legal case officer with an authority, the Ombudsman will normally notify him or her about the complaint. Pursuant to the Danish Act on Data Protection, everybody is entitled to know that authorities and others are in possession of information about them in their IT system.

If someone requests access to the public files in a complainant’s case with the Ombudsman, the Ombudsman will consider the request according to established principles laid down in the Danish Public Administration Act, the Danish Access to Public Administration Files Act and the Danish Act on Data Protection. There may be circumstances where others are entitled to access to some of the information in the case.
